1. Terms

1.1. In addition to the terms specified in the Flowwow Terms of Use (https://flowwow.com/ae-en/docs/terms-of-use/), for the purpose of this Flowwow Loyalty Programme:

‘Flowwow Loyalty Programme’ (the ‘Loyalty Programme’) means this document posted on the Internet at https://flowwow.com/ae-en/docs/loyalty/.

‘Programme’ means a set of interrelated actions and activities that provide Programme Participants with an opportunity to receive Bonus Rewards when purchasing Items from Partners and/or when performing certain actions, including ordering Delivery of Items, as well as in other cases established by the Loyalty Programme.

‘Operator’ means FLOWWOW - FZE, license number 17505 (DSO FZE Technohub, unit G-D_FLEX-G056C, Dubai Technology Entrepreneur Campus, Dubai Silicon Oasis, Dubai, United Arab Emirates), which is the owner and operator of the Programme and carries out its activities in accordance with the legislation of the United Arab Emirates.

‘Programme Participant’ (‘Participant’) means a legally capable individual using the Service to purchase Items who has confirmed his or her agreement with the terms of the Loyalty Programme.

‘Partner’ means a legal entity that has undertaken to carry out Promotions/participate in Promotions under the Loyalty Programme.

‘Promotion’ means a marketing and/or advertising event aimed at building and increasing Participants’ loyalty to the Operator, Partners, and the Programme as a whole, carried out at the initiative of the Operator and/or the Operator and a Partner. The Operator may indicate valid Promotions in the Loyalty Programme and/or in its Appendices.

‘Bonus Points’ means conventional virtual units accrued to a Participant when purchasing Items on the Service and/or for performing certain actions, as well as in other cases established by the Loyalty Programme, and giving the Participant the right to receive Bonus Rewards. Bonus Points are used only within the framework of the Programme, and in no wise are they or can they be money, other means of payment, currency, monetary obligations, or securities, nor can Bonus Points be transferred to third parties, except in cases provided for by the Loyalty Programme. one (1) Bonus point equals one (1) conventional unit in accordance with the Participant’s chosen currency on the Service. Bonus points shall not expire over time, unless otherwise specified when they are awarded.

‘Bonus Rewards’ means a way to attract Participants and encourage them to purchase Items from Partners on the Service and to increase their loyalty, expressed in the provision of discounts, special service terms, etc.

‘Bonus Account’ means a virtual counter in the Participant’s Personal Area on the Service that displays information about the Bonus Points accrued and available for debiting.

‘Cashback’ means Bonus Points calculated and accrued as a percentage of the cost of the Items paid for by a Participant.

‘Accrual of Bonus Points’ means a procedure that results in an increase in the number of Bonus Points on a Participant’s Bonus Account on grounds provided for in the Loyalty Programme.

‘Debiting of Bonus Points’ means a procedure that results in a decrease in the number of Points on a Participant’s Bonus Account on grounds provided for in the Loyalty Programme.

‘Cancellation of Bonus Points’ means a procedure for Debiting of Bonus Points on grounds provided for in the Loyalty Programme.

‘Restoration of Bonus Points’ means a procedure for Accrual of previously debited Bonus Points on grounds provided for in the Loyalty Programme.

‘Coupon Code’ means a certain sequence of characters that, if it is activated and other conditions are met, provide a Participant with a Bonus Reward in the form of a discount on an order and/or an Item. The Coupon Code is generated by the Operator/Partner in the Personal Area and sent by the Operator to the Participant.

‘Referral Coupon Code’ shall mean a unique Coupon code provided by the Participant to a third party whereby, when placing an Order with the Service, the third party shall receive a Bonus point reward in the form of a discount on the Goods. A Bonus Reward in the form of a discount is provided upon placement of the first Order on the Service, which amount equals or exceeds HUF 2000 (two thousand) (or equivalent in another currency specified with the Service at the time of Order placement), and amounts to 15% of the cost of the Items contained in the Order. The Referral Coupon Code can be used when placing Orders with Sellers who participate in the WowPass programme ( icon or with shops labelled ‘Accepts bonus points’ on the product card).

‘Coupon Code Activation’ means entry of a Coupon Code in the Order form on the Service or any other action provided for by the terms of use of the Coupon Code.

‘Transaction’ means a purchase by a Participant of an Item from a Partner or the return of an Item to the Partner, as well as the Accrual of Bonus Points, Debiting of Bonus Points, Cancellation of Bonus Points, and/or Activation of a Coupon Code.

‘Delivery’ means a service for the delivery of Items purchased by a Participant.

‘Delivery Discount’ means a reward consisting of a discount provided by the Operator/Partner on the cost of shipping.

1.2. The Loyalty Programme may use terms not defined in clause 1.1 of the Loyalty Programme. In this case, the given term shall be construed in accordance with the text of the Loyalty Programme. In the absence of an unambiguous interpretation of the term in the text of the Loyalty Programme, one should be guided by the interpretation of the term defined by the legislation of the United Arab Emirates or in the Service or generally used on the Internet.

2. General Conditions

2.1. This Loyalty Programme defines the conditions and procedure for Participants’ participation in the Loyalty Programme. The goals of the Loyalty Programme are:

  • attracting new users of the Service and retaining existing ones;
  • forming and increasing Participants’ loyalty to the Operator, Service, Partners, and the Programme as a whole;
  • reducing the marketing expenses of the Operator and Partners;
  • expanding the market share and increasing the profits of the Operator and Partners.

2.2. Within the framework of the Loyalty Programme, Participants accumulate Bonus Points and receive Bonus Rewards under the conditions stipulated by the Loyalty Programme.

2.3. Within the framework of the Loyalty Programme, Participants participate in the Operator’s/Partner’s promotions or receive a discount on Delivery without using Bonus Points under the conditions stipulated by the Loyalty Programme.

2.4. In one Order, the Participant may use only one Bonus Reward.

2.5. The Operator has the right to set the validity period and determine other circumstances upon the occurrence of which the provision of Bonus Rewards shall be terminated.

3. Procedure for Accrual, Debiting, Restoration, and Cancellation of Bonus Points

3.1. For the purchase of Items from Partners, the Operator credits the Participant with Bonus points as a percentage of the cost of the Items paid for by the Participant. The rate for accrual of Bonus Points is set by the Partner and displayed on the Service for each Item separately. Bonus points are credited to the Participant within one (1) business day from the Order’s execution date. When calculating Bonus Points, the cost of Items paid for using Bonus Points/Coupon Codes is not taken into account. Bonus points are not accrued for the Delivery of Items.

3.2. In addition, Bonus Points are awarded to a Participant after execution of the Order from a third party to whom the Participant has provided a Referral Coupon Code, provided that the third party used the Referral Coupon Code in question when placing the Order. The amount of bonus points is determined by the Participant’s choice of currency on the Service and is recorded in Annex 1 to the Flowwow Loyalty Programme. Annex 1 is available at the link: https://flowwow.com/s/tarif-lp-eu-en. The Bonus Points specified in this clause of the Programme shall be awarded to the Participant for no more than seven (7) Orders placed by third parties using a Referral Coupon Code.

3.3. Bonus points can be used by the Participant during the validity period specified at the time of their accrual. Bonus points can be used when placing Orders with Sellers who participate in the WowPass programme ( icon or with shops labelled ‘Accepts bonus points’ on the product card).

3.4. The Operator shall debit Bonus points when a Participant activates a Bonus Reward when placing an Order on the Service based on the number of Bonus Points reflected in the Bonus Account, without charging any additional fees. When several Items are purchased simultaneously, Bonus Points are distributed between the Items and Delivery in proportion to their value. Bonus points are debited by the Operator in full regardless of the cost of the Order and the number of Bonus Points reflected in the Bonus Account.

3.5. The minimum cost of an Order that the Participant must pay without using Bonus Points is one (1) conventional unit of the Participant’s chosen currency on the Service for each position in the Order (Items and Delivery), which the Participant must pay if the total number of Bonus Points is greater than or equal to the cost of the Order.

3.6. If the Participant cancels the Order and/or Items under the conditions specified in the Flowwow Terms of Use, the debited Bonus Points:

  • if the Order is cancelled before the Order status on the Service changes to ‘Ready for delivery’ / ‘Photo before delivery’ – shall be restored by the Operator to the Participant’s Bonus Account within ten (10 ) days;
  • iin the event of refusal of Items after the Order status on the Service changes to ‘Ready for delivery’ / ‘Photo before delivery’/when returning Items:
    • in the event of a full refund to the Participant of the cost of the Order – shall be restored by the Operator on the Bonus account of the Participant within ten (10) days;
    • in the event of no refund/partial refund of the cost of the Order to the Participant – shall not be restored.

3.7. When the Participant returns a purchased Item, the Bonus Points accrued for its purchase shall be debited by the Operator from the Participant’s Bonus Account.

3.8. The Operator will cancel Bonus Points in the following cases:

  • expiry of the term set by the Loyalty Programme;
  • deletion of the account by the Participant;
  • expulsion of the Participant from the Loyalty Programme or withdrawal of the Participant from participation in the Programme;
  • erroneous accrual of Bonus Points, including as a result of software malfunction;
  • the accrual of Bonus Points was the result of abuse of the Loyalty Programme or bad-faith actions of the Participant or third parties.

4. Procedure for the Provision, Activation, Restoration, and Cancellation of Coupon Codes. Delivery Discount Procedure

4.1. The Operator/Partner, to promote the Service and drive sales of Items by increasing the number of active users and maintaining the loyalty of existing ones, has the right to provide Participants with Coupon Codes, upon the Activation of which the Participants are provided with Bonus Rewards in the form of a discount on an Order and/or an Item. The discount amount shall be determined by the Operator/Partner independently and shall be reflected on the Service at the time of Activation of the Coupon Code.

4.1.1. Participants cannot redeem coupon codes for the Seller’s Own orders (i.e. Orders placed by a User via a direct link to the Seller’s Materials posted by the Seller on third-party services on the Internet).

4.2. Upon activating a Coupon Code when placing an Order on the Service, the Participant is provided with a Bonus Reward in the form of a discount on the Order and/or an Item equal to the face value of the Coupon Code, without any additional fees. When several Items are purchased at the same time, the discount is distributed:

  • Coupon code in absolute (monetary) terms – between the Items and the Delivery in proportion to their value;
  • Promotional code in percentage terms – between Items.

4.3. A participant can use a Coupon Code during the validity period specified at the time of its provision. The Coupon Code can be used when placing Orders from Sellers who participate in the WowPass programme ( icon on the product card). When paying for an Order, Coupon Codes are not cumulative and do not carry over to following Orders.

4.4. The minimum cost of an Order which the Participant must pay without using a Coupon Code or Delivery discount is one (1) conventional unit of the Participant’s chosen currency on the Service for each position in the Order (Items and Delivery), which the Participant must pay if the nominal value of the Coupon Code or Delivery discount is greater than or equal to the cost of each position in the Order (Items and Delivery).

4.5. If the Participant cancels an Order and/or Item under the conditions specified in the Flowwow Terms of Use, the activated Coupon Code:

  • if the Order is cancelled before the Order status on the Service changes to ‘Ready for delivery’ / ‘Photo before delivery’ – shall be restored by the Operator to the Participant’s Bonus Account within ten (10) days;
  • in the event of refusal of Items after the Order status on the Service changes to ‘Ready for delivery’ / ‘Photo before delivery’/when returning Items:
    • in the event of a full refund to the Participant of the cost of the Order – shall be restored by the Operator on the Bonus account of the Participant within ten (10) days;
    • in the event of no refund/partial refund of the cost of the Order to the Participant – shall not be restored.

4.6. The Operator will cancel a Coupon Code in the following cases:

  • expiry of the term set by the Loyalty Programme;
  • deletion of the account by the Participant;
  • expulsion of the Participant from the Programme or withdrawal of the Participant from participation in the Programme;
  • erroneous provision of the Coupon Code, including as a result of software malfunction;
  • the provision of the Coupon Code was the result of abuse of the Loyalty Programme or bad-faith actions of the Participant or third parties.

4.7. The Operator/Partner, to promote the Service and stimulate sales of Items and Delivery services by increasing the number of active users and maintaining loyalty, has the right to provide Participants with a Delivery Discount.

5. Miscellaneous

5.1. If the Participant does not agree with the Loyalty Programme, he or she must immediately stop using the Service.

5.2. In the event of abuse of the Loyalty Programme by a Participant, including the commission of fraudulent actions aimed at obtaining Bonus Rewards, the Operator reserves the right to restrict the Participant’s access to the Service according to the Flowwow Terms of Use.

5.3. The Operator has the right to change the text of this Loyalty Programme at any time. Such changes shall take effect from the publication date unless otherwise expressly stated at the time of publication. The Participant undertakes to check the Loyalty Programme for changes independently.
